Terms and Conditions

In order to use the Services, you must first agree to the Terms. You may not use the Services if you do not accept the Terms. The charter fee includes the services of a Skipper and crews, meals, standard ship's bar, fuel and all expenses related to running of the vessel and use of on-board sport equipments. Charter fee does not include diving, scuba equipment, premium beverages and fine wines, excessive alcohol consumption, off yacht excursions, dockage, cruising taxes and permits, airport transfer and crew gratuities, or similar expenses incurred by the charterers.

1. General

1.1 Bookings and reservations are taken on a first-come, first-serve basis, subject to the availability of the specified yacht.

1.2 All infant below the age of 3 are free-of-charge, and age from 4 and above will be considered as adults. (Children's age is calculated base on month and year; activities will be restricted for safety purpose).

1.3 All price listed are in Malaysia Ringgit (MYR)

1.4 G Luxury Tour Sdn Bhd. and its subsidiaries are Fully licensed and Insured companies. Every guests participating in any of the activities would be requirement to sign an indemnity form, prior to commencement of the said activities. All guest will be required to read and understand its content before signing the said form.

1.5 In particular, G Luxury Tour Sdn Bhd, its subsidiaries and affiliated, and do not represent or warrant to you that:

(a) Your use of the services will meet your requirements

(b) Your use of the services will be uninterrupted, timely, secure or free from error.

2. Payment

2.1 Upon confirmation of the preferred activities and in order to secure a firm booking, 50% deposit must be made. By depositing 50% you are agreeing to our Terms and Conditions.

2.2 Remaining 50% of charter fees and payment for any add-on options is due 3 days prior embarkation date.

2.3 Additional charges may apply for special requests other than item listed as per boat.

3. Cancellation, No-show and Refund Policy

3.1 Cancellations made less than 72 hours (3 days) prior to the yacht charter date are subjected to 100% of the charter fee, with no refund or rescheduling allowed.

3.2 For cancellations made less than 1 week prior to the yacht charter date, deposit of 50% will be forfeited.

3.3 For cancellations made more than 1 week in advance, G Luxury Tour Sdn Bhd may, at our discretion, allow a refund of up to 80% of the full charter fee. (Except for School Holidays and Public Holidays, G Luxury Tour Sdn Bhd may, at our discretion, allow a refund of no more than 50% of the full charter fee.)

3.4 All refunds may be made in the form of a cash refund, or bank transfer.

3.5 Cancellations made within office hours count towards the effective cancellation period stated above. Cancellations made after office hours will be counted beginning from the next working day.

3.6 Any refund, if applicable, shall only apply to the charter fee component. Charges for food catering or other services will not be refunded should charter be cancelled for any reason.

3.7 The charterer and guests are advised to be on time. No time compensation will be given for late arrival, and charter timings shall proceed as according to the stipulated timing as agreed upon, and stated on the invoice.

3.8 No-show policy: Arrival one hour after the stipulated charter start timing shall be considered as no-show, unless the coordinator is being notified. No refunds will be given for no-shows, and the charter shall be considered as fulfilled.

3.9 Time extension policy: Any time extension should be requested at least 72 hours in advance (subject to availability) prior to charter date. G Luxury Tour Sdn Bhd may allow impromptu time extension with cash payments on the spot, subject to the yacht availability and the sole discretion of G Luxury Tour Sdn Bhd.

3.10 G Luxury Tour Sdn Bhd reserves the right to cancel any charter in the event of any unforeseen circumstances. In such cases, we may mutually agree on a later date of charter. Claims for any damages and/or inconvenience caused will not be entertained.

3.11 Flexibility may be exercised where possible, with special considerations made by G Luxury Tour Sdn Bhd at our sole discretion on a case-by-case basis.

3.12 Curtailment of Charter: In the event that the yacht is unable to sail due to mechanical reasons prior to the scheduled charter, company will refund the full charter amount to the Charterer. In this event, there will be no further rights or claims for the damages or compensations from the Charterer.

3.13 G Luxury Tour Sdn Bhd reserves the right to substitute another yacht of the same or lower charter value prior to the scheduled charter should the specified yacht not be available due to reasons beyond our control. If a substitute yacht is not possible, the cancellation policy shall apply.

4. Responsibilities of Charterers

4.1 Charterer agrees to stay within the approved cruising ground as provided by G Luxury Tour Sdn Bhd and/or by law.

4.2 Prior to check in, charterer will check that boat and equipment is in good working order and up to minimum standards. At this tine, charterer can note with G Luxury Tour Sdn Bhd anything it believes contrary or below the standards as set forth.

4.3 Upon delivery, The Charterer is liable for loss of or damage to the yacht or its equipment that results from the negligence or willful misuse by Charterer, Charterer’s family and guests. Determinations of negligence or wilful misuse are made at the sole discretion of G Luxury Tour Sdn Bhd. Any damages done to the yacht will be recorded. The charterer would be responsible on behalf of their guests to rectify or to pay for the repair cost.

4.4 Charterer agrees to carry only up to a number of passengers required by security rules of the boat. Charterer agrees that he/she will not transport merchandise or carry passengers for pay or have any other commercial activity.

4.5 Each country has its own set of laws regarding drug use, weapon possession and alcohol consumption. As the penalties for such activities are severe, the captain and crew have the duty to report to the authorities and G Luxury Tour Sdn Bhd holidays the right to end a charter as soon if any such activity takes place onboard the yacht with a minimum of MYR3000 fine. If such activity persist, it is of the charterer's responsibility and charterer's and/or official officers are to waive and release any claims which they have or may have in the future against G Luxury Tour Sdn Bhd.

4.6 Any likeness or image of you or your party onboard our chartered vessel secured during your charter may be used by G Luxury Tour Sdn Bhd without charter in all media for bona fide promotional or marketing purposed, including without limitation promotional materials of any kind, such as brochures, slides, videos, advertisements and the internet.

4.7 CHILD AGE. Minimum child age for jet ski and any on-sea activities is 7 years old. Children below 17 years old must be accompanied by parents/guardians or an operator.

4.8 PREGNANCY. We do not allow expectant mother to participate in any of the following activities, namely parasailing/Jetski/banana boat/kayaking. Non-disclosure will be entirely at your own risk.

4.9 Security may perform searches and confiscate any illegal items for the safety of all our guests.

4.10 Max weight per jetski is 150kg for 2 riders.

5. Language of terms

5.1 Where G Luxury Tour Sdn Bhd has provided you with a translation of the English language version of the Terms, then you agree that the translation is provided for your convenience only and that the English versions of the Terms will govern your relationship with.

5.2 If there is any contradiction between what the English language version of the Terms says and what a translation says, then the English language version shall take precedence.

6. Health

All participants must be physically fit and able. They use, at all time of the booking, advise of any illness, disability or conditions that may affect their ability to participate in the activity. If at all unsure, guests must check with a medical practitioner before booking and must bring any necessary medication with them and ensure that staffs are aware of what medication and how it is to be administered. Be advised that some of the activity locations are remote and self-contained. G Luxury Tour Sdn Bhd reserves the right to refuse any booking on medical grounds if the medical condition is considered to be detrimental to the safety and smooth running of the charters.

7. Weather Policy

Malaysia is a tropical climate country with occasional passing showers and thunderstorms. For rain, the charter will continue to proceed. If there is a thunderstorm, the Captain may advise you to stay in the yacht until it is safe to be outdoors, at the same time all water activities will be prohibited.

7.1 For extreme weather, our company will receive warning letters from the marine department days before, in that case we will make full refund, and booking will be considered as cancelled.

7.2 For rainy weather, charter will proceed. However, we may delay the cruise embarkation time, and return at a later time.

7.3 The decision to depart, or reach back to Royal Langkawi Yacht Club is ultimately the Captain’s and Company's responsibility, with the safety of all passengers and crew as their primary concern. If under sailable circumstances and passengers decided to not proceed with the cruise, G Luxury Tour Sdn Bhd will only allow a refund of 20%, and remaining 80% will be forfeited.

7.4 Food and beverage orders are considered sold with no refunds or credits.

Our company will make the final decision as to whether it is safe or not to travel, dependent on the weather. Even if you might think it is safe and feel disappointed that your charter is departing later than expected or holding up the itinerary, the captain will only ever bring a halt to proceedings in the interests of everyone's safety - guests, crew and his own.

Naturally the charter itinerary may change slightly as a result of bad weather but the company, captain and crew will always endeavour to ensure that the remaining itinerary is as perfect as it can be. Each situation, although rare, being different, remember to keep an open mind about it and trust your Captain and crew when they make suggestions for alternative solutions, their aim is to make sure your charter experience remains the best possible.
